The Cottage

FAIR TRADING TERMS
Please read this page carefully. When you book your holiday with the owner you are entering into a contract which binds you and the owner in various ways.
Your holiday maybe the most important purchase you make this year, so it is essential that the obligations between you and the owner are clear, concise and fair.

TERMS AND PRICES
You may commence occupation of your holiday-home between 4.00pm and 6.00pm or such other time that is mutually agreeable (subject to any unavoidable delays). You must vacate by 10.00am on the day of departure. You are expected to leave your accommodation in a clean and tidy condition; failure to comply with this vacation procedure will result in an extra charge being levied.
All terms are per week for each self catering holiday. As soon as the booking is made by you and confirmed by us with our booking confirmation, the hire terms are fully guaranteed and will not be subject to any surcharges. The prices quoted are in sterling and payment is required by sterling cheque. No facilities exist to except payment by credit card.

MAKING A BOOKING
You must complete and sign the booking form, accepting on behalf of your party the terms of the booking conditions, sending it to us with your deposit. The submission of the completed booking form shall constitute an offer by you and a contract shall come into existence when we issue a booking confirmation. For bookings within 8 weeks of the arrival date you must pay the full hire charge and all other costs at the time of booking. For booking from overseas (outside the European Union) 50% of the hire charge is required as a deposit.

PAYMENT OF BALANCE
The amount payable will be shown on the confirmation booking. It must be paid at least 8 Weeks before your arrival date. If you fail to pay on time, the owner reserves the right to treat your holiday as cancelled by you. In this case we will retain your deposit and the provisions of clause 4 will apply.

INSURANCE
You must state the name of your insurer on your booking form. Please read your policy details carefully. It is your responsibility to ensure that the insurance cover you purchase is adequate for your needs and covers your personal liability to at least 1,000,000 euros.

CANCELLATION BY YOU
Telephone the owner immediately if you have to cancel, and on the same day send us your confirmation booking by first class mail. Your cancellation is effective from the date we receive your written confirmation, which will be acknowledged. If you cancel less than 56 days or more before your arrival date you will only forfeit your deposit. If you cancel less than 56 days before your arrival date you will be responsible for the balance as well, less any hire charges we may be able to recover through re-letting. You should ensure that you obtain adequate insurance cover for cancellation or curtailment.

NUMBER OF PERSONS
The maximum number of persons allowed in each self catering holiday home is shown in the property leaflet and all persons occupying the property must be named on the booking form, including the ages of those less than 18 years.

INCLUDING IN THE PRICE
Electricity and bottle gas (if applicable).

MINORS
Bookings from persons aged less than 18 years cannot be accepted.

ALL MALE AND FEMALES BOOKINGS
At proprietor’s discretion

UNSUTABLE HIRERS
The owner has the right to refuse to hand over a holiday home to any person who in her opinion is not suitable to take charge. In addition, the owner has the right to repossess a holiday home at any time if in her opinion, you or any member of your party is unsuitable to remain in charge because of their age, ill health, disability, suspected or actual influence of alcohol or drugs, or any other reason, or because of behaviour likely to cause danger to themselves, other persons or property. In this situation the owner will have no further responsibility or liability and no refunds, costs or expenses will be made or met.

AVAILABILITY
If the owner is prevented by circumstances beyond her control from making the holiday home available and cannot provide a suitable alternative, she will refund money already paid by you, but no further liability will be accepted.

YOU’RE VEHICLES
The owner accepts no responsibility for any loss or damage from or to any vehicle from any cause whatsoever other than that caused by our negligence.

FORCE MAJEURE
The owner regrets that she cannot accept liability and no compensation will be payable where the performance or prompt performance of our contract with you is prevented or affected by force “majeure”. In these fair trading terms, “force majeure” means any event which we could not, even with all due care, have avoided or foreseen. Such circumstances may include war, riot, civil strife, and industrial action, and terrorist activity, natural or nuclear disaster, fire, adverse weather conditions, technical problems with transport, closure, or congestion of air, rail or sea ports, cancellations or charges of schedules by scheduled airlines, all similar events outside our control.

YOUR RESPONSIBILITY
You are responsible for the fully furnished holiday home and its equipment during the period of hire, and are expected to take all responsible care for it. You are asked to notify the owner of any problems of defects immediately when they become apparent, to enable the owner to rectify them and maintain the high standards set by the owner. You undertake to report and pay for any damages caused to the holiday home for equipment lost, damaged, broken or stolen during your occupancy. You maybe asked to pay a security deposit at the time of paying the balance of the rental. If no loss or damage has occurred the security deposit will be repaid to you after the holiday home has been checked.

LIABILITY
The owner shall not be responsible to you or anyone at the holiday home or at its premises.

COMPLAINTS PROCEDURE
The owner wishes to know of any dissatisfaction. Complaints should be made in writing to the owner. It is not possible to refund any money paid until your complaint is fully investigated.
